Welcome to PayHalal. These Terms & Conditions govern your access to and use of the PayHalal website, platform, and services. By accessing or using PayHalal, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
1. Definitions

“Platform” refers to the PayHalal website, mobile applications, and related services.

“PayHalal”, “we”, “us”, or “our” refers to PayHalal and its operators.

“Merchant” refers to third-party sellers offering products or services on the Platform.

“Shopper”, “User”, or “you” refers to any person accessing or using the Platform.

“Product(s)” refers to goods or services listed by Merchants on PayHalal.
2. Nature of the Platform (Multi-Vendor Marketplace)
PayHalal operates as an online marketplace that connects Shoppers with independent Merchants.

PayHalal does not own, manufacture, or sell Products, unless expressly stated.

Each Merchant is solely responsible for their listings, pricing, fulfilment, warranties, and compliance with applicable laws.

Any contract for sale is strictly between the Shopper and the Merchant.
3. Eligibility & Account Use

You must be at least 18 years old to use the Platform.

You agree to provide accurate, complete, and up-to-date information.

You are responsible for maintaining the confidentiality of your account credentials.

PayHalal reserves the right to suspend or terminate accounts for misuse or violations.
4. Use of the Platform
You agree not to:

use the Platform for unlawful or fraudulent purposes;
-
interfere with or disrupt Platform operations;
-
upload malicious code or harmful content;
-
infringe intellectual property or privacy rights;
-
misuse reviews, ratings, or dispute mechanisms.
PayHalal reserves the right to remove content or restrict access at its discretion.
5. Products, Listings & Pricing

Product descriptions, prices, availability, and images are provided by Merchants.

PayHalal does not guarantee accuracy, completeness, or reliability of Merchant listings.

Prices may change without prior notice.
-
Errors in pricing or descriptions may result in order cancellation.
6. Orders & Payments

All orders are subject to acceptance by the Merchant.

PayHalal supports multiple payment methods, including but not limited to:

FPX
-
eWallets
-
Debit Cards
-
Credit Cards
-
Cash on Delivery (where available)
-
Payment processing may involve third-party service providers.
7. Delivery & Fulfilment

Delivery is handled by Merchants or their appointed logistics partners.

Estimated delivery timelines are indicative only and not guaranteed.

PayHalal is not responsible for delays caused by Merchants, couriers, customs, or force majeure events.
8. Returns, Refunds & Cancellations
All cancellations, returns, refunds, and exchanges are governed by the PayHalal Cancellation, Exchange, Returns & Refunds Policy, which forms an integral part of these Terms.
Merchants are required to comply with the policy and applicable consumer laws.
9. Merchant Responsibilities
Merchants agree to:

provide lawful, halal-compliant (where applicable), and authentic Products;

comply with Malaysian laws and regulations;
-
fulfil orders promptly and accurately;
-
handle disputes, returns, and warranties fairly;
-
ensure all listings are truthful and not misleading.
PayHalal may take enforcement action against non-compliant Merchants.
10. Intellectual Property
All content on the Platform, including text, logos, designs, and software, is owned by or licensed to PayHalal and protected by intellectual property laws.
You may not reproduce, distribute, or exploit any content without prior written consent.
11. Reviews & User Content

Users may submit reviews and feedback.

Reviews must be honest, lawful, and non-abusive.

PayHalal reserves the right to remove reviews that are misleading, defamatory, or inappropriate.
12. Limitation of Liability
To the maximum extent permitted by law:

PayHalal shall not be liable for indirect, incidental, or consequential damages.

PayHalal does not guarantee uninterrupted or error-free operation of the Platform.

PayHalal is not responsible for acts or omissions of Merchants or third-party service providers.
13. Indemnity
You agree to indemnify and hold harmless PayHalal from any claims, losses, liabilities, or expenses arising from:

your misuse of the Platform;
-
your breach of these Terms;
-
your violation of any law or third-party rights.
14. Suspension & Termination
PayHalal may suspend or terminate access to the Platform without prior notice if:

these Terms are breached;
-
fraudulent or harmful activity is detected;
-
required by law or authorities.
15. Changes to Terms
PayHalal reserves the right to modify these Terms at any time.
Changes take effect upon posting on the Platform. Continued use constitutes acceptance.
16. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia.
Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
